What role has Persona played in the Tribunal’s inquiries into the second mobile phone licence process?

Persona has been very heavily involved at all stages of the Tribunal’s private and public inquires into the second mobile phone licence competition process. This involvement by Persona in the Tribunal’s activities includes the various steps / points of interaction as set out below. Documents establishing each of these steps can be found under the relevant heading.

 

Visitors to this site are strongly encouraged to review these documents in order to make up their own minds in relation to the appropriateness or otherwise of Persona’s interaction with the Tribunal and the appropriateness or otherwise of the relationship between Persona and Jerry Healy SC.

 

  • Meeting privately with the Tribunal’s legal team on numerous occasions during which meetings numerous allegations were made against various individuals involved in the licence competition process (including allegations being made against several senior and respected civil servants).

  • Providing a written waiver to the Moriarty Tribunal in favour of their former Senior Counsel, Jerry Healy SC, such that Mr. Healy could privately disclose to the Tribunal Chairman material and/or information that he had been privy to during his time as legal adviser to Persona in its efforts to challenge the awarding of the licence to Esat Digifone.Note: The Moriarty Tribunal refused to provide copies of this waiver correspondence to interested parties. However the text of the letters was read into the Tribunal record on Day 304 by Eoin McGonigal SC (Counsel for Mr. Denis O’Brien).   • Providing voluminous materials to the Tribunal that Persona itself had compiled following its own lengthy inquiries with the European Commission.

  • Writing to the Tribunal criticising and seeking to challenge evidence being given contemporaneously by senior civil servants from the Department of Transport, Energy and Communications during public sittings of the Tribunal and suggesting lines of questioning that ought to be put to those witnesses.

  • Meeting numerous third parties for the purposes of eliciting information and material relating to the Tribunal’s inquiries and filtering that information through to the Tribunal.
